These Terms & Conditions govern your access to Always On Commerce websites, dashboards, APIs, and commerce experiences. By using our services, you agree to these terms.

Agreement to terms

These Terms & Conditions apply to your use of Always On Commerce products, including our marketing site, merchant dashboard, coupon and verification APIs, Shopify integrations, and consumer commerce experiences such as reels and swipe.

If you do not agree, do not use the services.

Eligibility

You must be at least 18 years old, or the age of majority where you live, to use consumer reward and checkout flows.

Business users must have authority to bind the organization they represent.

Our services

Always On Commerce provides commerce media, attribution, coupon issuance, catalog sync, and related tools for brands, agencies, and partners.

Features may change over time. We may add, modify, or discontinue features with reasonable notice when practical.

Store credit, coupons, and promotions

Promotional amounts, store credit, cashback, free shipping thresholds, and in-game rewards shown in an experience are subject to merchant rules, inventory, geography, eligibility, and campaign limits.

No purchase is necessary to request a verification SMS or claim an eligible offer unless a merchant's checkout terms state otherwise for redemption. Offers are limited to one per person, phone number, or household where stated, and may be unavailable, changed, or ended at any time.

By tapping a claim button and providing your phone number, you agree to receive a transactional verification SMS for that offer. Message and data rates may apply. Verification messages are used to confirm eligibility, prevent duplicate claims, and issue or honor the promotion.

Accounts and authentication

Dashboard and platform users are responsible for safeguarding login credentials and for activity under their account.

You must provide accurate registration information and notify us promptly of unauthorized access.

Acceptable use

You may not misuse the services, interfere with normal operation, scrape or reverse engineer protected areas without permission, submit false verification data, or use Always On Commerce to send spam or unlawful content.

We may suspend or terminate access for violations.

Intellectual property

Always On Commerce retains rights in its software, branding, documentation, and platform design. Merchant trademarks, product media, and campaign assets remain the property of their respective owners.

You receive a limited license to use the services as intended while your access remains active.

Disclaimers

The services are provided on an as-is and as-available basis to the fullest extent permitted by law. We do not warrant uninterrupted or error-free operation.

Always On Commerce is not the seller of record for merchant products unless explicitly stated in a separate agreement.

Limitation of liability

To the fullest extent permitted by law, Always On Commerce and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data arising from your use of the services.

Our aggregate liability for any claim relating to the services is limited to the greater of one hundred U.S. dollars or the fees you paid Always On Commerce for the service giving rise to the claim during the twelve months before the event.

Suspension and termination

You may stop using the services at any time. We may suspend or terminate access if you breach these terms, if required by law, or to protect the platform, merchants, or users.

Changes to these terms

We may update these Terms & Conditions from time to time. We will post the revised version on this page and update the last updated date.

Continued use after changes become effective constitutes acceptance of the revised terms.

Always On Commerce Promotional Terms

These Promotional Terms govern all promotional offers administered by Always On Commerce unless otherwise stated on the offer page.

Campaign variables

Offer-specific details

Eligibility

You must be at least 18 years old, or the age of majority where you live, to participate unless the offer page states a higher age requirement.

Promotions are open only to residents of eligible jurisdictions listed on the offer page. Offers are void where prohibited or restricted by law.

Offer

The specific reward, value, sponsoring brand, redemption method, expiration date, and any extra eligibility terms are described on the offer page or in the campaign variables shown above.

Rewards are subject to availability, campaign limits, merchant rules, inventory, and geography. We do not guarantee that every offer will remain available.

Verification

A valid mobile phone number may be required to request or claim a promotional reward. By tapping a claim button and providing your phone number, you agree to receive a transactional verification SMS for that offer.

Always On Commerce may use SMS or other verification methods to confirm eligibility, prevent duplicate claims, and issue or honor the promotion. Message and data rates may apply.

Limits

Unless the offer page states a different limit, each promotion is limited to one reward per person, phone number, device, household, or account at Always On Commerce's discretion.

Duplicate, automated, incomplete, ineligible, or fraudulent claims may be denied, canceled, or reversed.

Reward delivery

Rewards are delivered electronically unless otherwise stated on the offer page. Delivery may occur through a coupon code, checkout link, store credit, in-game reward, or another digital method described in the campaign.

Always On Commerce is not responsible for delivery issues caused by incorrect information, unavailable merchant systems, expired offers, or third-party checkout errors.

Marketing messages

Verification SMS messages are transactional and tied to the offer claim flow. They are separate from marketing messages.

Marketing consent is optional unless a campaign clearly states otherwise. If you opt in to marketing messages, the opt-in terms shown at that time apply.

Modification and termination

Always On Commerce or the sponsoring brand may modify, suspend, or end a promotion at any time, including when inventory, budget, eligibility, technical, fraud, or legal constraints require it.

Previously earned rewards will generally be honored according to the offer terms unless they were obtained through fraud, abuse, mistake, or a violation of these Promotional Terms.

Fraud and abuse

Automated signups, fake or disposable phone numbers, VPN abuse, device spoofing, repeated account creation, referral manipulation, or other attempts to manipulate promotions may result in disqualification.

Always On Commerce may withhold, cancel, or reverse rewards when we reasonably believe a claim violates these Promotional Terms or the offer page.

Privacy

Always On Commerce processes phone numbers, verification events, session identifiers, attribution data, and redemption data as described in our Privacy Policy.

We may share promotion and attribution data with the sponsoring brand or agency so they can fulfill offers, prevent abuse, and measure campaign performance.

Liability

Promotions are provided on an as-available basis. Always On Commerce is not the seller of record for merchant products unless a separate agreement states otherwise.

To the fullest extent permitted by law, Always On Commerce and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from a promotion, reward, verification message, merchant checkout, or third-party service.
